1. Acceptance of Terms

By accessing or using the Prete Jewels website at https://prete.in (the "Service"), or by placing an order for any product, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Prete Jewels ("we," "us," or "our"). We reserve the right to update these Terms from time to time, and your continued use of the Service following any changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age, or have reached the age of majority in your jurisdiction, to make purchases on our Service. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including un-discharged insolvents, are not eligible to use the Service for commercial transactions. If you are under 18 years of age, you may browse the Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

3. Products & Descriptions

Prete Jewels is an Indian direct-to-consumer jewellery brand offering fine 92.5 sterling silver and handcrafted designer imitation jewellery:

  • BIS Hallmarked 92.5 Sterling Silver: Solid sterling silver jewellery bearing the official Bureau of Indian Standards hallmark, ensuring 92.5% purity. Hand-set with premium grade Zirconia and sealed with anti-tarnish rhodium or micron gold plating.
  • Handcrafted & Imitation Jewellery: Intricately designed traditional and contemporary jewellery crafted from skin-safe brass and copper alloys with durable micro gold/rhodium plating. These pieces are fashion jewellery and do not contain precious solid gold or real gemstones unless explicitly stated.
  • Artisanal Variations: Because our jewellery pieces are handcrafted or hand-finished, slight natural variations in colour, stone placement, texture, or weight are inherent characteristics of fine artisanal craftsmanship.

4. Pricing, Taxes & Currency

All prices displayed on the Service are listed in Indian Rupees (INR) and are inclusive of Goods and Services Tax (GST) at applicable rates.

We reserve the right to modify prices at any time without prior notice. Price changes will not affect orders that have already been confirmed with an Order ID and payment receipt. While we strive to ensure absolute pricing accuracy, in the rare event of a typographical or technical pricing error, we reserve the right to cancel the order and issue a 100% full refund.

5. Orders & Contract Formation

When you place an order on our Service, your order constitutes an offer to purchase. An order is deemed accepted only when you receive an official Order Confirmation via email or SMS with an assigned Order ID. We reserve the right to decline or cancel any order for reasons including, but not limited to, inventory unavailability, inaccuracies in product information, suspected fraudulent activity, or unserviceable delivery locations.

6. Payments & Security

Online payments are processed securely through our authorized payment gateway partner, Razorpay. We accept major Credit/Debit Cards (Visa, MasterCard, RuPay, American Express), UPI (Google Pay, PhonePe, Paytm, BHIM), Net Banking across 50+ Indian banks, and authorized digital wallets.

All transactions are encrypted with 256-bit SSL encryption and comply with RBI standards and PCI-DSS Level 1 compliance. Prete Jewels does not store, process, or have access to your complete payment card numbers, CVV, UPI PINs, or net banking passwords on our servers.

7. Shipping & Doorstep Delivery

We provide insured doorstep delivery across India to over 19,000+ pincodes via trusted express logistics partners:

  • Dispatch: Orders are verified and dispatched within 1–3 business days.
  • Delivery Timeline: Standard transit takes 3–7 business days depending on destination pincode.
  • Shipping Charges: Free shipping is provided on orders above ₹999. Standard shipping fee of ₹79 applies on orders below this threshold.

8. Return, Refund & Cancellation Policy

We want you to be completely delighted with your jewellery. Our returns policy operates as follows:

  • 5-Day Return Window: You may request a return within 5 calendar days of parcel delivery.
  • Condition: Items must be unworn, undamaged, in original condition with security tags and original velvet/box packaging intact.
  • Unboxing Requirement: For claims regarding transit damage or missing items, customers are requested to record a continuous unboxing video upon opening the sealed parcel.
  • Refund Processing: Approved refunds are credited directly back to your original payment method via Razorpay within 5–7 business days following quality inspection at our facility.
  • Order Cancellation: You may cancel an order before it has been dispatched by contacting customer support. Dispatched orders cannot be cancelled in transit but may be returned post-delivery.

9. Intellectual Property

All content on the Service—including but not limited to the Prete Jewels trademark, brand logos, product photography, jewellery designs, editorial text, graphics, icons, and software—is the exclusive intellectual property of Prete Jewels and is protected under Indian and international copyright and trademark laws.

You may not copy, reproduce, modify, republish, distribute, sell, or exploit any content or imagery from this Service for commercial purposes without our prior express written permission.

10. User Conduct

By using our Service, you agree not to:

  • Use the Service for any fraudulent, unlawful, or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Transmit any malicious code, viruses, automated bots, scrapers, or exploits.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Provide false or misleading billing, shipping, or contact information.

11. Disclaimer of Warranties

The Service and all products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except for official BIS Hallmark certifications specifically accompanying designated 92.5 sterling silver items.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Prete Jewels and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, this Service or products purchased. In all circumstances, our maximum aggregate liability for any claims arising under these Terms shall not exceed the total amount paid by you for the specific product giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Prete Jewels, its employees, partners, and authorized agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be subject to the exclusive jurisdiction of the competent courts located in Thrissur, Kerala, India.

15. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and Prete Jewels regarding your use of the Service and supersede all prior agreements and understandings.
